Résumé

This Government Decree regulates the quality of drinking water in order to protect human health by eliminating any type of contamination of drinking water and ensuring that its clean and healthy water. This Regulation does not apply to: (a) natural mineral waters recognized as such by the competent authorities in accordance with current legislation; and (b) medicinal drinking waters with the declared medicinal properties in accordance with laws, regulations and administrative actions affecting pharmaceutical products. An exception to this Regulation is: (a) water intended exclusively for special use in cases where the Ministry of Health, Labor and Social Protection approves its use and quality that does not have a direct or indirect impact on consumer health, for which it is produced; and (b) drinking water coming from an individual water producer supplying on average less than 5 m3 per day or serving less than 50 people, unless when water production is part of a commercial or government activity. Drinking water must be healthy and clean and meet the following conditions: (a) do not contain microorganisms, parasites or substances that, by their quantities or concentrations may pose a potential hazard to human health; (b) meet the minimum requirements specified in tables 1 A, 1 B and 2 of the Annex No. 1; and (c) comply with the provisions of Articles 5-8 and 10 of this Regulation. The application of this Regulation should not directly or indirectly affect the reduction of real quality of drinking water, which may affect human health, or increase the level of contamination of water used to produce drinking water. Drinking water quality monitoring is provided by the manufacturer, supplier and bodies of the State Sanitary and Epidemiological Supervision Service. Territorial bodies of state supervision of public health must guarantee the availability of information regarding the quality of drinking water, informing the consumer about possible impacts on public health and about remedial measures taken or to be implemented by competent authorities or consumers. Information must be reliable, clear, timely and up-to-date. Producers and consumers of drinking water submit to territorial authorities of State Sanitary and Epidemiological Supervision Service necessary information for drawing up the National Report on quality of drinking water. Violation of the provisions of this Regulation entails material, civil, disciplinary, administrative or criminal liability in accordance with the Code of administrative offenses.
