Résumé

This Act makes provision for the registration, use and protection of a geographical indication, i.e. an indication that identifies goods as originating in the territory of a country, or a region or locality in that territory, where a given quality, reputation or other characteristic of the goods is essentially attributable to its geographical origin. Protection under this Act is accorded to geographical indications whether or not they are registered. The Registrar of Corporate Affairs and Intellectual Property shall, in cases of permitted concurrent use of homonymous geographical indications, determine the practical conditions under which such indications will be differentiated from each other. The Act prohibits improper use of geographical indications.
