Résumé

This Regulation enacts provisions governing forest roads and is divided into 5 parts as follows: Part 1 - Definitions and Application; Part 2 - Road Layout and Design; Part 3 - Construction and Modification; Part 4 - Maintenance and Part 5 - Deactivation. Part 2 of this Regulation prescribes exemptions from the requirement of road permits, road use permits and a district manager approval of a road layout and design for construction, as provided for under the Forest Practices Code of British Columbia Act. With regards to a community watershed area, a soil erosion field assessment for all areas where road construction or modification is proposed should be undertaken. The content of road layout, design and drainage design is also dealt with under this part of the Regulation, as well as requirements for the design of bridges, culverts, etc. Part 3 specifies the required preparation when constructing or modifying a road in compliance with section 62 (1) of the Act, as well as drainage construction and road surfacing. Revegetation is also covered, requiring that in the first growing season after completion of construction, modification or deactivation, seed be applied in accordance with vegetation that will support vegetation in areas the Regulation specifies. Part 4 goes into detail regarding bridge and major culvert inspection, evaluation and maintenance and road inspection and maintenance. Finally under part 5 before commencement of road deactivation activities, the person who is required to deactivate the road under section 64 of the Act must erect a sign at a location or locations, warning of the hazard. General wildlife measures in wildlife habitat areas must also be observed.
