Résumé

This Ordinance provides a regulatory framework for the placing on the market of food. As a general rules, food must not be placed on the market if it is unsafe. “Food” includes any substance or product, whether processed, partially processed or unprocessed, intended to be, or reasonably expected to be ingested by humans. Any food commonly used for human consumption is, if sold or offered, exposed or kept for sale, presumed, until the contrary is proved, to have been sold or, as the case may be, to have been or to be intended for sale for human consumption. The Health Protection Board established by section 3 of the Public Health Ordinance, 1932 is the Regulatory Authority for the purposes of this Ordinance. The Regulatory Authority must enforce and execute the provisions of this Ordinance and has such other functions as the Governor considers appropriate in relation to the operation of this Ordinance. The Regulatory Authority may issue Codes of recommended practice for the guidance of the Food Authority as regards the execution and enforcement of this Ordinance and of regulations and orders made under it. Director of Health, the Senior Medical Officer/clinical Director and the Senior Environmental Health Officer ("Food Authority") must carry out official controls to verify the food business operator’s compliance with the requirements of this Ordinance. The Ordinance defines powers of enforcement, regulation-making powers of the Governor and offences.
