The Food Safety Authority shall establish a risk-based food safety and quality control framework to protect, enhance and ensure food safety and to protect consumers against food fraud. The certification requirements will be established by the Authority for food business operators with respect to hygiene and manufacturing, recognised by the Codex Alimentarius Commission. The National Food Safety Committee and National Codex Committee will be established to advise the Minister on matters pertaining to food safety. The food inspector may, at any reasonable time, enter and inspect any premises which are engaged in the production, processing, manufacturing or other preparation of food for human consumption; the handling or sale of food including street food vending; the import or export of food; and the growing, harvesting or other preparation of plants and micro-organisms for use as food. In order to operate a food business, the person who uses or intends to use any premises for the purpose of a food business shall register the premises with the Authority and may apply for a licence. This Act sets forth strict obligations for food businesses in the fields of food traceability, food safety and hygiene. This Act underlines that no one shall display for sale or sell food unsafe, injurious to health or unfit for human consumption, and sell food that has been genetically modified unless the requirements as set out by the National Bureau of Standards have been satisfied. The Minister may publish in the Gazette a list of food that requires inspection at a port of entry before exportation from Guyana or upon importation into Guyana. In case a food product is found or suspected to be a health hazard, that product will be recalled for analysis or destruction if it has not yet been exported.
