Résumé

This Act regulates the handling and the sale of food and sets related standards; it consists of 302 sections and is divided into 12 Chapters. The stated objectives of the Act are (a) ensuring food for sale is safe and suitable for human consumption; (b) preventing misleading conduct relating to the sale of food; (c) applying the food standards code. These purposes are to be achieved primarily by providing for the licensing of particular food businesses and requiring particular licensees to have an accredited food safety program. The compliance with this Act and the food standards code has to be monitored and enforced. Chapter 2 specifies offences relating to food, including handling of food in unsafe way, sale of unsafe or unsuitable food, false description of food, misleading conduct relating to sale of food and non compliance with food standards code. Chapter 3 is dedicated to licences for particular food business. Chapter 4 is on accredited food safety programs, required in order to identify food safety hazards that are reasonably likely to occur in food handling operations of the food business and to provide for appropriate corrective action to be taken. Chapters 5 and 6 regulate the functions and approval of the auditors and the procedures related to audits of accredited food safety programs. Chapter 7 contains provisions for the monitoring and enforcement of the Act. Chapter 8 sets provisions for the analysis of things made by State analysts and Chapter 9 for the internal and external review of decisions. Chapter 10 provides for legal proceedings and Chapter 11 contains provisions of miscellaneous nature. The Act is completed by two Schedules on: changes to food standards code and dictionary.
