Résumé

These Regulations are made in accordance with the Flexible Land Tenure Act, No. 4 of 2012. The Regulations establish two general principles; that a starter title scheme or a land hold title scheme must accommodate 25 to 100 households unless circumstances make it desirable to have a different number and that all persons affected by the establishment of a starter title scheme or a land hold title scheme must actively participate in the design, planning, establishment and implementation of the scheme applicable to them and their skills and capacities for that purpose must be actively developed by the relevant authority within available resources. The Regulations also lay down certain institutional arrangements relating to Land Rights Office, including its administration and management. A computer system may also be used in relation to registers, even though the Regulations provide that the information stored in a computer system is not strictly a register. The Regulations provide specifications for land hold title registers and steps for the approval of title schemes for same; similar provisions are available for the starter title scheme. The Regulations also contain provisions for the registration, cancellation or otherwise of mortgaged plots and servitudes.
