Résumé

These regulations apply to fish and fishery products which are to be placed on the market for human consumption produced (a) on vessels, establishments and installations designated under the Fishery Products (Vessels, Establishment and Installations) Regulations 2014; and (b) in fish farming establishments licenced under the Fish Farming Ordinance. Part 2 prohibits the import, sale and use of unauthorised or prohibited substances on fish and fishery products (general prohibition of substances listed under Schedule 2 and other listed substances), and sets the maximum residue limits for certain substances (Schedule 5). Part 3 establishes the controls and monitoring of fish going for slaughter, the official controls by the competent authority, and the checks and approval before fish or fishery products are placed on the market for human consumption. Part 4 his designates the inspectors and the designated laboratories, and specifies the procedures for sampling, testing, examinations, inspections and audits of fish and fishery products. Part 5 describes the further investigations and actions by the competent authority in case of positive results for contaminants, residues or illegal treatment of fish and fishery products. Part 6 covers the notices, appeals, record keeping, guidance, obstruction and offences and penalties related to the regulations. The document also has six schedules that list the substances or products to be monitored, the unauthorised/prohibited substances, the substances subject to monitoring or checking, the sampling strategy and levels, and the maximum levels for certain contaminants in fish and fishery products.
