Résumé An Act concerning any business or undertaking that involves fishing or raising, possessing, using, culturing, processing, packaging, marketing, carrying, transporting or disposing of any fish. Under section 3, the property of all wild fish is vested in the Crown. The Act contains provisions on the licensing requirements and procedures (sects. 10-16) and spells out which are the powers and duties of the officers involved in the implementation and enforcement of the Act, also in terms of investigations and inspections (sects. 17-25). The Act also contains provisions on offences. Under section 26, if a person is convicted of an offence under the Act, the fish seized is forfeited to the Crown, and any fishing gear or equipment seized can either be returned or forfeited to the Crown. As specified in section 38, nothing in this Act affects the validity of any licence issued pursuant to the Fisheries Act (Canada) or its regulations.
