Résumé

Section 1 of this Act contains appropriate definitions to this Act, all further sections are repealed until section 35 where upon the Act appoints a fire commissioner and staff, and sets out their duties section 36 sets out the procedure of inquiries into causes of fires, and the nature of the evidence. The Commissioner may divide the province into districts by virtue of section 38(1). He may for each district appoint one or more persons (hereinafter called "assistants") as assistants to the fire commissioner. They are to prepare reports with regards to fires, and collect reports of fire insurance companies, (sect. 40). Section 45(2) permits the Lieutenant Governor in Council to appoint a committee representative of the city, town, village, or municipal district, and the province; which shall act in an advisory capacity to the fire commissioner. Section 46 entrusts the fire commissioner with all the power, authority and jurisdiction of a judge of the Court of Queen's Bench or a provincial judge for all purposes connected with any inquiry or investigations conducted by him under this Act. The following provisions deal with his powers in more detail, namely issuing warrants, powers of arrest, investigation and enquiry; orders and appeals, offences and penalties. Section 66 deals with property insurance. Section 67 sets up a Fire Prevention Fund, and sets out its nature. The Lieutenant Governor in Council is empowered to make regulations by virtue of section 68.
