Résumé This Law, consisting of 20 articles organized into seven chapters, aims to govern the trade of goods in relation to the rules of origin. Rules of origin are defined as the fundamental criteria that determine the country from which a commodity originates, based on this Law or international agreements, as well as the issuance of certificates of origin. To determine the country of origin, the Law categorizes commodities into three groups (i) Fully acquired commodities; (ii) Commodities that have undergone substantial preparation, processing, or manufacturing; (iii) Insufficient processing cases, which are instances where the processing of a commodity is deemed insufficient or secondary, whether conducted individually or jointly, to attribute the commodity with the country of origin. Article 6 establishes that the Ministry of Economy will issue certificates of origin, both preferential and non-preferential, for national goods exported abroad. The relevant department will maintain a record of all preferential and non-preferential certificates of origin and retain copies for a minimum of three years. Customs departments are responsible for verifying the validity of the country of origin when there are substantial doubts about the validity of the certificate of origin or the origin of the products in question. The Cabinet will issue a decision, following the recommendation of the Minister of Finance, to specify the fees associated with preferential and non-preferential certificates of origin issued by the Ministry.
