Résumé

Family shall be intended a circle of persons connected by personal non-property and property rights and obligations arising from marriage, kinship, adoption or another form of acceptance of children into a family. Marriage is a voluntary equal union of a man and a woman, concluded in the procedure established by law for creating a family, giving rise to mutual rights and the responsibilities of the spouses. Spouses shall be intended persons who are married to each other (husband and wife). The purpose of the family legislation of Turkmenistan is to establish state guarantees for the protection of family, motherhood, fatherhood and childhood, the creation of conditions for the economic independence of the family and the growth of the well-being of all of its members. The tasks of the family legislation of Turkmenistan are: (a) voluntary creation of a family based on the mutual love of a man and a woman; (b) strengthening moral principles in the family; (c) ensuring equal rights of spouses in family relations; (d) increasing responsibility to the family of all its members; (e) protection of motherhood, fatherhood and childhood; (f) ensuring in the family favorable conditions for healthy development and education of a child; (g) preventing anyone from interfering in the affairs of the family; (h) non-admission of violence in any form against any member of families; and (i) creating favorable conditions in the family for parents to combine work activities with family responsibilities. In Turkmenistan, only a marriage registered by the registry office is recognized as legal. Polygamy is prohibited in Turkmenistan. Polygamy means cohabitation with two or more women and at the same time maintaining a common household. In family relations, spouses have equal personal non-property and property rights and obligations. Matters of motherhood, fatherhood, upbringing of children, their education and other issues of family life are resolved by spouses jointly, based on the principle of equality of rights and obligations of the spouses. The spouses are obliged to build their relations in the family on the basis of mutual respect and mutual assistance, promote well-being and strengthening of the family, take care of the well-being and development of their children. Property (immovable and movable), acquired by spouses during marriage, regardless of which of the spouses purchased it, is their common joint property. Spouses have equal rights to own, use and dispose of the joint property. Spouses have equal rights to joint property even when one of them was engaged in housekeeping (domestic work), childcare or other activities for valid reasons did not have an independent income. All children living on the territory of Turkmenistan have equal rights, regardless of nationality, race, gender, language, attitude to religion, origin, property or other status, education and place of residence of themselves and their parents, from the circumstances of their birth, state of health or other circumstances. The child has the right to enjoy all the rights granted to him and freedoms. The exercise of rights and freedoms should not have harmful consequences for life, health, upbringing and full development of the child. Equality of rights of the child is guaranteed by the laws of Turkmenistan, this Code and other regulatory legal acts of Turkmenistan, as well as generally recognized norms of international law.
