For the purpose of the present Regulations "excavation pit” means any excavation in the ground for the purpose of searching for or removing clay, gravel, sand, shale, subsoil, topsoil, rock or any other surface or subterranean deposit, but does not include an excavation made within the boundaries of a highway. Section 3 establishes that a contractor or a property owner who wishes to obtain a permit to open or operate an excavation pit shall apply for the permit on a form approved by the Minister.
