Résumé

These Regulations prescribe minimum quality standards and controls on the marketing within the European Union of fruit plant propagating material and fruit plants intended for fruit production. Subject to restrictions prescribed by regulation 5, these Regulations apply to: (a) fruit plant propagating material and fruit plants intended for fruit production which pertain to any of the genera or species listed in the Annex II of Directive 92/34/EEC as well as their hybrids; and (b) rootstock of genera and species not listed in the said Annex II, onto which material of genera or species so listed or their hybrids has been grafted. A person shall not market fruit plant propagating material or fruit plants to which these Regulations apply unless the conditions laid down in Annex I of Directive 92/34/EEC, as specified in the Annex to Directive 93/48/EEC, and in articles 2 to 9 of the said Directive 93/48/EEC have been complied with. The Minister Minister for Agriculture, Food and Forestry may, where the EC Commission makes a decision in that regard, authorize the marketing, during a period specified in the decision, of propagating material or fruit plants meeting less stringent requirements than those prescribed in these Regulations.
