It provides that, where, and for as long as, an authority, in relation to which section 96 of the Clean Neighbourhoods and Environment Act 2005 applies, is categorized in one of the categories specified by these Regulations, certain functions of that authority are specified as "qualifying functions" of the authority. The authority may use its fixed penalty receipts for such qualifying functions. The Regulations also provide for use of amounts that a Parish Council receives in pursuance of notices issued under specified legislation.
