Those activities may not be undertaken without an environmental clearance certificate issued by the relevant competent authority as identified in section 30 of the Act. After submitting the application to the competent authority the proponent must take various specified steps to complete the process including designation of an environmental assessment practitioner to manage the assessment process, conducting of a public consultation process in and submission of a scoping report and management plan to the Environmental Commissioner. Applicants and interested parties shall be registered and an assessment register is required to be kept in terms of section 33 of the Act. Decisions may be subject to an appeal to the Minister in terms of section 50 of the Act.
