Résumé These Regulations lay down litter control measures, waste related offences, enforcement provisions, and infringement notices. These Regulations made by the Minister of Environment under section 19(1)(c) of the Environment Management Act 2010, defines duties and offences in relation to waste pollution. Every owner and occupier of land or premises shall keep their land and premises free from litter and other waste which may become litter. Waste offences include the offence to dump waste or hazardous waste, the offence of dumping of waste that causes pollution, the offence of burning litter and waste or noxious or hazardous waste, the offence of disposal or dumping of prescribed hazardous waste. “Prescribed hazardous waste” includes ― (a) all ozone depleting substances; (b) all persistent organic pollutants; (c) asbestos, or any product containing asbestos; and (d) any other type of waste determined in accordance with any law to be a hazardous waste. Certain waste shall not be used for land filling or reclamation. An environment officer or any other authorised officer may issue a notice to cease certain activities concerning waste or issue a Notice of Infringement.
