Résumé

The Act consists of 14 Chapters divided into 66 sections. This Act provides for the establishment of the Bangladesh Energy Regulatory Commission to encourage private investment in the generation of electricity, and transmission, transportation and marketing of gas resources and petroleum products, etc. (Chapter 2). Chapters 3 and 4 deal with financial matters of the Commission, and with its functions, powers and proceedings. The Government shall have the power to give policy directives for the development and overall planning in the energy sector (Chapter 5). Licences shall be issued by the Commission for the following activities: power generation; energy transmission; distribution and marketing of energy; supply of energy; and, storage of energy (Chapter 6). Tariffs on power generation and on supply of energy shall be determined by the Commission in consultation with the Government (Chapter 7). The remaining Chapters deal with the following: flow of information; settlements and appeals; offences and penalties; and, provisions of miscellaneous nature.
