Résumé

Organic production, within the meaning of this emergency ordinance, means obtaining agro-food products without the use of synthetic chemicals, in accordance with the rules of ecological production established in this emergency ordinance, which respects the national standards, guidelines and specifications and are certified by an inspection and certification body established for this purpose. Ecological agri-food production aims to achieve sustainable, diversified and balanced agricultural systems, which ensure the protection of natural resources and the health of consumers. Genetically modified organisms and their derivatives are not allowed in organic food production. This emergency ordinance refers to products obtained and labelled in such a way as to inform the buyer that the product and/or, as the case may be, the ingredients in the product were obtained in accordance with ecological production methods, namely: (a) unprocessed primary vegetables and unprocessed animal products; (b) processed vegetable and animal products, intended for human consumption, prepared from one or more ingredients of vegetable and/or animal origin; and (c) feed, compound feed and raw materials. National Organic Products Authority (ANPE) is established as a specialized service within the Ministry of Agriculture and Food, which ensures compliance with specific legal provisions and control over methods of ecological production of agri-food products. The ecological production methods used in obtaining the organic agri-food products must meet the following conditions: (a) compliance with the principles of ecological production; (b) non-use of fertilizers and soil improvers, pesticides, feed materials, food additives, ingredients for food preparation, substances used in animal nutrition, auxiliary substances for the preparation of feed, products for cleaning and disinfecting shelters for animals and other products, than those products allowed to be used in ecological agriculture; and (c) the use of seeds or vegetative planting material obtained by ecological production methods. The conversion of conventional production to organic production will aim to achieve a viable and sustainable agrosystem. The labelling of ecological products is done in accordance with the legal regulations in force. The label must indicate the following: (a) the name and address of the manufacturer or processor; (b) the name of the product, including the ecological production method used; (c) the name and brand of the inspection and certification body; (d) storage conditions; (e) the minimum term of validity; and (f) the prohibition of storing ecological products in the same space together with other products.
