Résumé This Act provides for the procedure for and the principles of exploration, protection and use of the earth’s crust, with the purpose of ensuring economically efficient and environmentally sound use of the earth’s crust. This Act regulates: (a) geological investigation; (b) geological explorations; (c) extraction of mineral resources, except in the part regulated by the Mining Act; (d) the rights of the owner of an immovable upon use of mineral resources within the boundaries of the owner’s immovable; (e) restoration of the land disturbed by geological investigation, geological explorations or mining; (f) use of the earth’s crust not related to the extraction of mineral resources, except in the part regulated by the Mining Act and the Water Act; and (g) protection of the earth’s crust. Mineral deposits shall be classified as national and local. Mineral reserves shall be classified as proved reserves, inferred reserves and reconnaissance resources. Geological explorations are permitted on the basis of a geological exploration permit for mineral resources. Extraction of minerals shall be authorized in conformity with extraction permit with the term of validity varying from 15 to 30 years, subject to extension.
