Résumé This Decree lays down the conditions related to the loading of soil by the introduction of waste and the obligatory conduct in the planning and implementation of the introduction of earth excavation or artificially prepared soil in order to improve the ecological condition of that soil. For the purpose of this Decree, the improvement of the ecological condition of soil is the introduction of earth excavation or artificially prepared soil into or on the soil due to its reclamation, backfilling of land when establishing a new soil condition or due to filling excavations due to restoring the original soil condition; reclamation is a measure to restore soil fertility. This Decree shall not apply to the management of waste mineral raw materials, waste sediments and excavations that are so contaminated with hazardous substances that, in accordance with the regulation governing waste management, they are classified as hazardous waste. This Decree also determines the conditions for the use of construction materials prepared from treated or untreated, source or waste mineral raw materials, if hazardous substances may start to leach upon contact with rainwater, groundwater or surface water.
