The geological resources included in this Decree-Law are designated by: a) Mineral deposits; b) Mineral water resources; and e) Geothermal resources. The above mentioned geological resources included are not included in the public domain of the State, and may be the object of private property or other real rights, a) Minerals; b) Spring waters. In addition, it regulates authorization and licensing procedures. Title I specifies that the national territory and the exclusive economic zone comprise two types of areas for the purpose of exploring and exploiting mineral resources as part of the public domain: a) Reserved areas, defined as those on which rights derived from exploration and exploration licenses or rights; and b) Remaining available areas. With regard to resources that are part of the public domain, the following rights may be established: a) Exploration and research, permitting the practice of operations aimed at finding resources; b) Exploration, allowing the pursuit of the activity after exploration and research, that is, the economic exploitation of resources. The exploitation of resources which are not part of the public domain of the State depends on a previous establishment authorization. Title II deals with rights over the exploration and exploitation of resources in the public domain. Title III deals with restrictions to the private law regime.
