Résumé

The guidelines have been developed under subsection 8, of Art. 47 of the Decree-Law No. 77/2021 (Herein after Art. 47) that contain provisions promoting gender and generational equal opportunities, as well as the employment inclusion of people with disabilities in public contracts financed with resources of the PNRR and the PNC. These Guidelines apply both in the context of public tenders and contracts for an amount higher or lower than thresholds of European relevance. In particular, the provisions are aimed at commit companies to deal transparently with the analysis of own working context, through: a) the preparation and production of the report on the situation of the personnel, referred to in Article 46 of Legislative Decree 11 April 2006, no. 198 (art. 47, paragraph 2); b) the delivery of the gender report on the situation of the male and female personnel (art. 47, paragraph 3); c) the presentation of the declaration and the report about compliance with the rules governing the right to work of people with disabilities, referred to in Article 17 of the law 12 March 1999, n. 68 (article 47, paragraph 3-bis). The Guidelines also contain provisions on contractual clauses aimed at promoting youth entrepreneurship, recruitment of young people under thirty-six years of age, women and people with disabilities, among others.
