Section 64 of the Forest Act R.S.B.C. 1996, c. 157, entitled Cut Control, prescribes the permitted volume of timber to be harvested. Section 66 of the Act, allows a reduction in the allowable annual cut, if the volume of timber harvested during a calendar year is less than the minimum volume required by section 64 (1) (a) to be harvested in the calendar year. Under this Regulation, the regional manager, the minister or a person so authorized, on request of the holder of an agreement (to which section 64 of the Act applies), may refrain, in whole or in part, from making a reduction under section 66 of the Act, if the reason for the deficiency in the volume of timber harvested, was outside the control of the holder of the agreement. Notice of the decision made under section 2 or 3 of the Regulation, must be given to the holder of an agreement.
