The provisions of regulation No. 15 shall come into force on such date as the Cabinet of Ministers may, by Notice in the Gazette, determine. Résumé With the purpose of aligning the Cypriot legislation with Council Directive 2000/76/EC Council on the incineration of waste, the present Regulations aim at establishing measures to reduce and prevent pollution from the operation of newly established waste (hazardous and non) incineration plants in order to protect human health and the environment. In general, the Regulations provide that the newly established incineration and coincineration plants must obtain a waste gas emission permit by the competent authority. Permission is granted once the competent authority has ascertained that all necessary measures to protect public health and the environment have been taken. Under these Regulations the operator of the incineration and coincineration facility is required to present a full description of the waste to be incinerated and has to keep on specific procedures for receiving such substances. The incineration facilities of hazardous waste must be designed and operated so as to achieve the fullest possible incineration and the gas produced should be placed at a temperature of at least 850 ° C before passing into the atmosphere. Also, the facilities must be designed, equipped and operated so as not to overpass the prescribed emission limit values for a range of pollutants such as dust, organic matter, hydrogen chloride, hydrogen fluoride, sulphur dioxide, metals and dioxins. These limit values are set as conditions to the permit issued by the Minister. On incineration, the operator shall conduct measurements of the pollutants mentioned above in order to achieve compliance with the emission limit values. If these measurements show that the emission limit values are exceeded, the operator is obliged to inform the Minister without delay and to stop the emission of hazardous waste into the atmosphere until incineration is permitted again by the Minister. Measurements taken for determining concentrations of pollutants must be representative and should be carried out according to the approved CEN standards. In addition to the measurements carried out by the operator, the competent authority with regular and extraordinary inspections to ensure compliance with the permit conditions and impose penalties where there is a breach of these terms. The Regulations also include the obligation of the competent authority to prepare a report, on a three-year basis, regarding the implementation of the provisions and send it to the European Commission.
