This Act shall come into force on a day fixed by the Minister through an Order published in the Official Gazette.
Résumé

This Act lays down rules to promote and advance the social and economic welfare of consumers through the establishment of legal framework that enables fair, accessible, efficient, sustainable and responsible consumer market; promotion of fair business practices; consumer protection from unfair and improper practices; promotion of environmental responsibility in consumer markets; consumer awareness-raising to encourage responsible and informed consumer choice and behavior; and development of an accessible, consistent, harmonized, effective and efficient system of redress for consumers. This Act shall apply to all persons involved in trade or business whether through the purchasing or supplying of goods or services. This Act sets forth provisions on the establishment, structure, functions, and powers of Consumer Protection Board; procedures for the investigation and resolving of consumer complaints and disputes regarding goods and services; the establishment, composition, powers and proceedings of Consumer Protection Appeals Tribunal; terms and conditions of consumer agreements; consumer rights; duties of suppliers; false, misleading and deceptive presentation of goods or service, unfair methods or practices, and restrictive trade practices; consumer safety requirements; declaration of unsafe goods; establishment of a regional alert system; recall of goods; liability of any goods, including animal or agricultural produce; distance selling; and offences and penalties. The duties of suppliers are identified in this Act as(I) registration and identification of suppliers, (II) product labeling and trade descriptions, (III) disclosure of environmental facts on the packages, (IV) disclosure of used, re-conditioned, re-built and re-made goods, (V) supply of goods or service of reasonable and acceptable quality, (VI) charging consumer for assistance, (VII) providing all reasonable information to consumers, (VIII) disclosure of price of goods or service, (IX) issuing warranties in relation to goods or service, (X) providing service approved by the consumer, (XI) replacement or repair of damaged goods sold to consumer, and (XII) liabilities from breach of contract, duty or obligation. Consumer rights include the right to select supplier, goods or services, right to choose and examine goods, right to accept goods or service, right in relation to unsolicited goods or service, right to authorize service, right of consumers’ estate to choose whether to uphold consumer agreement, right to cancel reservation, right to cancel agreement or return the goods which are partially eaten, consumed, depleted or destroyed, right with respect to deliver of goods or supply of service, right to information in plain and understandable language, and right to information in English language. The Minister may make regulations for consumer safety in matters of safety of goods, and accurate and reliable information relating to goods.
