Résumé This Law, consisting of 44 articles divided into five Titles, establishes the State Policy on Climate Change. This Policy, in addition to the polluter-pays, user-pays, sustainable development and precautionary principles, shall comply with the following principles: Protector-receiver, allowing nature to provide environmental services to society; Recognition of the right of future generations, considering the actions necessary to be able to serve them in a long term horizon; The right to access to information, transparency and public participation in the decision-making process and access to justice in matters related to climate change; The recognition of the physical, biotic, demographic, economic, social and cultural diversity of the regions of the State in the identification of vulnerabilities to climate change and in the implementation of mitigation and adaptation actions; Prioritization of the most vulnerable and disadvantaged communities, affected by climate change, in the application of resources, measures and adaptation programmes; Protection of natural ecosystems as a way of conserving Brazilian biodiversity, contributing both to local and global climate balance and to meeting the objectives of the Convention on Biological Diversity to which Brazil is a signatory; Avoid deforestation, by maintaining the native vegetation areas for preventing climate change by ensuring that the carbon stored in its biomass is not released into the atmosphere.
