This Code of Practice comes into force on May 1, 2000.
Résumé

The present Code enacts the Water Act and the Water (Ministerial) Regulation. The Code lays down provisions relating to the practice for watercourse crossings which are structures crossing creeks, streams, ponds, or other surface areas of running or open water. They are typically used to provide a more confined, safer, and environmentally sensitive means for crossing from one side of a watercourse to the other. Furthermore, they may be either above or below the water surface. The type of crossing may vary with respect to length, width, height, and construction design, depending on the purpose of the crossing and the environmental and physical characteristics of the watercourse. Section 2 of Part 2 establishes that an owner and any person who carries out a works shall comply with the requirements set out in this Code of Practice. Furthermore, this Code of Practice does not apply to those watercourse crossings that are exempt from the requirement for an approval under the Water (Ministerial) Regulation. The text – consisting of 17 sections deals, inter alia, with the following aspects: emergencies, plans maps and class of water bodies, watercourse crossing types, temporary crossings, restricted activity periods, certification and confirmation, reporting, record keeping and information availability, monitoring of works, guidelines, effective date, code of practice review and amendment.
