Résumé

This By-law of the city of eThekwini (Durban) seeks to ensure sustainable use and development of the coastal area by aligning municipal planning with the Act National Environmental Management: Integrated Coastal Management Act. The By-law, among other things, establishes the Municipal Coastal Committee, gives effect to the Municipal Coastal Management Programme established under this Act and aims at protection of the natural environment of the coastal zone. This By-law must be read in conjunction with all applicable legislation, including but not limited to Biodiversity Act, the Marine Living Resources Act; the Mineral and Petroleum Resources Development Act; the Mountain Catchment Areas Act, the National Environmental Management Act and the National Forests Act. The By-law defines the role of the municipality in integrated coastal management. The Municipality must, in administering and implementing this By-law, give effect to and promote effective cooperative governance. The By-law also provides for public participation, alignment of the Municipal Coastal Management Programme and municipal statutory spatial tools and instruments with other coastal programmes, powers of the municipality to regulate, control and restrict activities in coastal protection zone, general environmental protection in coastal zone, designation od coastal access land, and enforcement.
