The present Act enters into force on 1 September 1989.
Résumé

An Act respecting the emission of air contaminants, to be intended as “a solid, liquid, gas or combination of any of them in the ambient air that contributes to air pollution” (sect. 2). The Act consists of 26 sections divided into 7 titles. Title 3 prescribes the appointment of an officer to be called the Director of Air Quality, such officer will control compliance with the provisions of the Act and of related regulations. Title 4 deals with permits. Permits are required for the operation and change of any industrial sources, incinerator or fuel burning equipment, the Act also indicates the exceptions to this general requirement (sect. 6). Sections 8 to 13 deal with the application, issuance and duration of permits. Title 5 deals with control orders to be issued by the Director of Air Quality for the purpose of preventing air pollution. Among others, the Director may require the person to whom the control order is issued to refrain from emitting an air contaminant permanently, for a specified period, during certain times; to install or replace any equipment designed to control or eliminate the emission of an air contaminant; to measure the concentration of an air contaminant in the ambient air or to carry out studies or investigations in response to a specific air pollution problem (sect 15). The Act also specifies that municipalities can make bylaws on matters related to air pollution, but, in case there is a conflict between a bylaw and the provisions of the Act or of related regulations, the Act or regulations prevail (sect 18).
