Résumé

The Bureau Of Indian Standards Act, 2016 establishes a national standards body known as the Bureau of Indian Standards for providing standardisation, conformity assessment and quality assurance of goods, articles, processes, systems and services. The Act is divided into 5 chapters as follows: Chapter I – Preliminary: provides the short title, extent (whole of India), commencement date (such date as the Central Government may, by notification in the Official Gazette, appoint) and definitions. Chapter II - Bureau of Indian Standards: establishes the Bureau and lays down the constitution of Governing Council, Executive Committee, Advisory Committee, Appointment of Director-general, officers and employees and provides for the powers and function of the Bureau. Chapter III - Indian Standards, Certification And Licence: states that the standards established by the Bureau shall be the Indian Standards and empowers the Bureau to establish, publish, review and promote the Indian Standard or adopt as Indian Standard, any standard, established by any other Institution in India or elsewhere and recognise or accredit any institution in India or outside which is engaged in standardisation. This Chapter provides for Grant of licence or certificate of conformity and allows the Central Government to direct compulsory use of Standard Mark if it is in the public interest or for the protection of human, animal or plant health, safety of the environment, or prevention of unfair trade practices, or national security. Chapter IV - Finance, Accounts And Audit: contains provisions relating to the financial management, fund, budget, annual report and audit of the Bureau. Chapter V – Miscellaneous: provides for Powers to the Central Government to issue direction to the Bureau on questions of policy, Appointment and powers of certification officers, Penalties and Compensation and Appeal Provisions.
