Under owners liability, the owner of an animal is liable for damages resulting from harm to a person or to property caused by their animal, however an award of damages can be reduced in proportion to the degree of contributory negligence of a plaintiff section 2(1). No owner or person in charge of an animal is permitted to allow it to run at large (sec 5). Section 6(2) provides that any person who finds: (a) dog, (b) wild boar; or (c) prescribed animal (prescribed in the regulations); worrying, injuring or killing livestock on the premises of the owner or possessor of the livestock, may destroy the dog, wild boar or prescribed animal without their permission. Alternatively, a request for a destruction order can be made, (sect. 7(1)) followed by a hearing if requested.
