Résumé The Act consist of 31 sections divided into 5 Parts and deals with agricultural operations defined as operations carried out on a farm in the expectation of gain or reward. Under section 3, owners and operators of an agricultural operation are not liable to any person in nuisance if they use normally accepted agricultural practices and the onus of proving that an operation creates nuisance lies on the plaintiff or claimant. Part 2 establishes the Agricultural Operation Review Board and regulates its internal structure and functioning. The Board is responsible for solving disputes related to nuisance of agricultural operations. Part 3 deals with intensive livestock. A plan for the management of waste from intensive livestock is required and sections 20-26 provide for the submission, approval and monitoring of the plans. The Act also includes general provisions on liability (sect. 27) and on regulations to be made under the Act (sect. 28).
