Résumé

The present Act lays down provisions relating to hunting and fishing rights in the James Bay and New Québec Territories. The Hunting, Fishing and Trapping Regime established by this Act applies in the Territory in the manner provided in this Act and is subject to the principle of conservation. “Conservation” means the pursuit of the optimum natural productivity of all living resources and the protection of the ecological systems of the Territory so as to protect endangered species and to ensure, primarily, the continuance of the traditional pursuits of the Native people, and, secondarily, the satisfaction of the needs of non-Natives for sport hunting and fishing. For the carrying out of this Act, the Territory is divided into three zones, namely Northern zone, Middle zone and Southern zone. The Act consists of 102 articles divided into 13 chapters as follows: General provisions (II); Application of the Act respecting the conservation and development of wildlife (III); Territorial application (IV); Application to Crees, Iniut and Naskapis (V); Right to harvest (VI); Commercial fisheries (VII); Commercial hunting and the keeping in captivity and raising of wildlife species (VII.1); Reserved species (VIII); Non-native hunting and fishing (IX); Outfitting operations (X); Coordinating Committee (XI); Powers of the government and of the authorities (XII); Guaranteed levels of harvesting (XIII); Regulations (XIV); Penal provisions (XV).
