Entry into force notes
This Act enters into force on the date specified by a Cabinet Order within a period not exceeding four months from the day of promulgation.
Résumé

This Act aims to introduce a new national framework for offshore wind projects in Japan. The Act outlines a process for offshore Marine Renewable Energy Power Generation Facilities development in Japan's national waters. Specifically, it addresses development of offshore wind facilities in high seas and other areas which are outside of Japan's ports. Offshore wind development within ports and harbours is already covered under the Ports and Harbours Act. The Act provides a much needed framework for industry participation by: setting out the process by which designated marine areas where offshore wind development can be undertaken, known as "Promotion Zones", will be established; establishing guidelines on the public tender process for projects within such Promotion Zones; and indicating the process by which tenderers will be able to compete to secure occupancy rights for offshore wind projects. Based on the basic policy, competent authorities shall designate certain areas of Japan's territorial and inland waters that meet the specific criteria as Development Promotion Areas for Marine Renewable Energy Power Generation Facility.
