This Subpart of Part 216 of the Code of Federal Regulations (Regulations governing the taking and importing of marine mammals) concerns the protection of dolphins by prescribing the requirements for using the official mark described in this Subpart or an alternative mark that refers to dolphins, porpoises, or marine mammals, to label tuna or tuna products offered for sale in or exported from the United States using the term dolphin-safe or suggesting the tuna were harvested in a manner not injurious to dolphins. These requirements are specified for products containing tuna harvested by eastern tropical Pacific Ocean (ETP) large purse seine vessel or by Non-ETP purse seine vessels, for vessel engaged in large-scale driftnet fishing and for (all) other fisheries. the Regulations also concern compliance with the tracking and verification program to accurately document the dolphin-safe condition of tuna, dolphin-safe certification and other control measures. The official mark on labels must allow the consumer to identify the official mark and be similar in design and scale to the figure set out in this Subpart.
