Prohibitions concern, subject to certain exceptions: the taking of marine mammals by U.S. citizens and in U.S. waters; importation of any marine mammal or marine mammal product into the U.S.; use, sale and transportation of marine mammals; violation of any term, condition, or restriction of any permit issued by the Secretary of Commerce. This Part of the Regulations also concerns marine mammals taken before (coming into force of) the MMPA, species or population stocks that have been designated by the Assistant Administrator as depleted under the provisions of the MMPA and resistance against enforcement officers. Further provisions concern special restrictions for Hawaiian spinner dolphins, and special restrictions for humpback whales in waters surrounding the islands of Hawaii.
