The Regulations in Part 216 implement the Marine Mammal Protection Act of 1972 (MMPA), which, among other things, restricts the taking, possession, transportation, selling, offering for sale, and importing of marine mammals. Nothing in this Part, nor any permit issued under authority of this Part, shall be construed to relieve a person from any other requirements imposed by a statute or regulation of the United States, including any applicable Statutes or Regulations relating to wildlife and fisheries, health, quarantine, agriculture, or customs. Enforcement Agents of the National Marine Fisheries Service shall enforce the provisions of the MMPA and may take any actions authorized by the MMPA with respect to enforcement. In addition, the Secretary of Commerce may utilize, by agreement, the personnel, services, and facilities of any other Federal Agency for the purposes of enforcing the MMPA. Pursuant to the terms of section 107(b) of the MMPA, the Secretary may also designate officers and employees of any State or of any possession of the United States to enforce the provisions of the MMPA.
