Résumé

Local council approved a change in a local plan. The change encompassed the inclusion of two areas for retail businesses. The decision was appealed to the Administrative Court where it was dismissed and later to the Supreme Administrative Court.

 

The area in question was situated close to Old Rauma, a site on UNESCO’s world heritage list as   one of the best preserved Nordic cities constructed in wood. Old Rauma also had a special status nationally and was protected by the Ministry of the Environment as an important cultural and historical site. It was therefore a protected zone and it was prescribed that when construction and activities were carried out in the area care should be taken not to interfere with the cityscape and the cultural heritage of the site.

 

The Supreme Administrative Court dismissed the appeal. The most important reason for this was that the area was not situated very close to Old Rauma and that there were similar commercial building even closer to the world heritage site. The court was of the opinion that the cultural and historical heritage would therefore not be affected by the changed local plan and the construction.
