The contested decision grants a general exemption for the use of DecaBDE a type of bromine-based flame retardant, principally used in polymers and in textile coating in electrical and electronic equipment. The Court ruled that the exemption Commission Decision 2005/717/EC granted to DecaBDE under the prohibition of Directive 2002/95/EC has not met the strict conditions laid down in Article 5(1) of the Directive.
