In this case, Respondent requested authorization to set up a fairytale path depicting the story “Lisa & Max” on 10 wooden panels (about 1.5 m high and 2 m wide) along the Sassweg hiking trail in Malbun, Liechtenstein. Under the Forest Act (WaldG), the Office for Forest Nature and Landscape (AWNL) found that the proposed fairytale project was considered an interference in nature and not compatible with the landscape under the Forest Law because the panels would significantly change the landscape. The local and municipal governments eventually decided to allow the interference. Appellant challenged this decision under the Forest Act, which grants exemptions for exploitations and sedimentation and authorizes the construction of installations, and the Nature and Landscape Protection Act. The lower court held in favour of the Respondent, and the Appellant appealed.

The court held that the Law on the Protection of Nature and Landscape allows for private associations, domiciled in Germany for at least 10 years in which they are are dedicated to nature conservation, landscape conservation, or related objectives, are allowed the right to appeal. However the Forest Act does not provide a right to appeal. As the Forest Act is the basis for the case, the complaint was rejected for lack of appeal. However, the court proceeds to clarify methods for applying Forest Law. The court found that under the Forest Law, it is the sole responsibility of the government to decide on exemptions in connection with the construction of structures and facilities in the forest, and not the municipal authority. However, the municipality may request exceptions from the government. When considering the request and exemption, the government must consider the nature and extent of the interference, the public interest in forest conservation, the public interest in tourism and economic benefits.
