City of Bradford Metropolitan Council v. Feather Pays/Territoire Royaume-Uni Date Déc 1, 1994 Source UNEP, InforMEA Numéro de référence [1995] 10 P.A.D. 267 Résumé A building and construction company appealed a local council failure to determine within the prescribed period an application for the erection of three wind turbine generators, an electrical sub-station, and cables at a quarry in Haworth, West Yorkshire. On appeal, the Planning Inspector acknowledged the contribution that wind energy generation would make in this case to the national energy supply in achievement of national policies on renewable energy, but concluded that it could not outweigh the harm that the proposal would cause to the surrounding landscape. The noise created by the turbines, though not a compelling objection on its own, added weighed against approval of the application.Key environmental legal questions:Appeal of local council decision denying planning permission for wind turbines Texte intégral UK-Bradford-1994-10-PAD-267.pdf Site web climatecasechart.com
