Complicity to the crime of sand theft – evidence.

He is considered an accomplice of a crime, everyone that did not directly contribute in the implementation of a crime, but did one of the acts stated in the said Article by helping or assisting the principal author in committing the material act of the crime. That why we cannot imagine the participation in a crime after it was committed. The court that issued the appealed decision convicted the plaintiff in cassation for the participation in a crime of sand theft, beyond the fact that he came after the truck was loaded with sand and covered a long distance from the place of loading, the act he was charged with in itself does not constitute one of the elements stated in Article 129 of the criminal code, which is considered as a breach of the said Article and makes its decision lacks explanation and is subjects to overruling.
