Résumé

The applicant sought approval of a planning permit and challenged the local council’s request for a coastal hazard vulnerability assessment (CHVA) considering the impact of increased inundation or changing sea level conditions due to climate change prior to permit approval. The Australian State Court found that the Council must give the applicant an opportunity to demonstrate why a CHVA was not required for the specific review site and take this information into account prior to the Council determining whether a CHVA is required.
