Resumen

Since the enactment of CERCLA in 1980, purchasers of real estate often must discover hazardous waste contamination before closing transactions or risk facing CERCLA liability: This article surveys state laws enacted to protect buyers from acquiring contaminated property and from the high costs associated with CERCLA liability. The article also discusses existing federal disclosure law and proposes a national uniform disclosure law to remedy present inadequacies in state and federal law
