Resumen

This law sets up the legal regime of police and protection of waters (for consumption, swimming pools, thermal and mineral waters, wastewater). The law is formed by 60 articles organized in 7 Titles (including a preliminary title). The preliminary title defines the objectives of the law. The following titles are dedicated each to the regulation of a type of water. The first Title, made up of two sections and 4 chapters, lists all the types of water that fall into the definition of drinking waters (chapter 1) and regulates their protection and surveillance, with a particular focus to bottled water (chapter 2). The second Title is dedicated to the regulation of the establishment of swimming pools which are not reserved to personal or family use. The third Title, divided in two chapters, is dedicated to hot springs and minerals intended for therapeutic or industrial use. While the first chapter sets up the conditions upon which and the authority to declare a water as thermal or mineral, the second chapter establishes how to take advantage of the thermal and mineral waters. The fourth Title, made up of four chapters, covers the evacuation and discharge of wastewater and rainwater (chapter 1), the conditions of discharge into surface waters (chapter 2), the conditions for the opening and maintenance of water treatment and purification plants (chapter 3), the water conduction at the sewer network as a condition for the authorization for real estate construction, with a particular focus to the drainage of industrial waters that come from activities especially dangerous. The fifth Title, divided in two chapters, concerns the protection of the surface waters and the regulation of wastewater discharge (chapter 1) and the classification and control of the surface waters according to their quality to determine their use (chapter 2). The sixth Title, which covers sanctions and responsibilities, is organized in two chapters, the first of which, concerning offences and penalties, is composed of three sections (general provisions, offences, penalties). The second one concerns the responsibility for repairing any damage caused to public and private waters, in addition to any penalties that may be imposed on the basis of the previous chapter. Additional and transitional provisions terminate the law.
