Resumen

This Resolution of the Medicines Control Council and approved by the Minister of Health, determines that all oral preparations which- (1) contain a bacterial strain(s) as listed in the Schedule hereto, either as such or in combination with any other pharmacologically active ingredient(s); and (2) make a medicinal claim other than the general health claim provided for their use as a Schedule 0 substance, shall be subject to registration as medicines falling under Category A referred to in regulation 9(1) of the Regulations promulgated in terms of the Medicines and Related Substances Act, 1965. Section 22A of the Act provides for a graduated system of control over sale and supply of substances, ranging from access via any retail outlet, at one extreme, to outright prohibition, at the other. Although no list of Schedule 0 substances is provided in the Schedules, a preamble states that “This Schedule includes all substances or mixtures of substances subject to registration in terms of the Act and which are not listed in any of the other Schedules”.
