Resumen

The Regulation consists of 9 Sections dealing with the following matters: 1) general provisions (sect. 1); 2) the rights and the duties of the lessees of fishing waterbodies (sect. 2); 3) fishing species and fishing quotas (sect. 3); 4) fishing gear and fishing methods (sect. 4); 5) restricted fishing periods (sect. 5); 6) restrictions and prohibition (sect. 6); 7) protection of fishing waterbodies, fishing resources and liability for the infringement of fishing regulations (sect. 7); 8) liability for the infringement of the legislation and compensation of damages caused to fishing resources (sect. 8); 9) dispute settlement (sect. 9). The present Regulation determines fishing methods, fishing seasons and fishing quotas for industrial fisheries and it shall be applicable to all fishing waterbodies except for fish farming ponds and hatchery fish farming enterprises. Industrial fisheries shall be prohibited on the territory of protected areas and national parks. Industrial fisheries shall be considered catch of fishes and aquatic invertebrates by the authorized fishing methods with the utilization of the authorized fishing gear. Fishing species can be any fish except for species recorded in the Red Book or temporarily prohibited for catch by the Ministry of Natural Resources and Environmental Protection. Fishing Committee attached to the Ministry of Environmental Protection and Natural Resources shall issue fishing permit (licence) for carrying out industrial fisheries in the fishing waterbodies conceded on lease or for usufruct. The lessees of fishing waterbodies must use them for the established purpose and in conformity with the contractual clauses, to ensure the conservation of spawning and wintering grounds, not exceed the established quotas, and, in case of the fulfilment of quota, to stop fisheries and to inform the fishing inspection. For some fishes and aquatic invertebrates shall be set minimum size in conformity with Annex 2. The authorized fishing gear shall be marked and registered by the fishing inspection. The prohibited fishing season of sixty days shall be imposed during spring spawning. The following fishing practices shall be prohibited: 1) the use of explosives, firearms, spearheads, chemicals and drugs; 2) the use of unregistered and uncertified fishing gear; 3) excess of quotas.
