Resumen

This Law establishes the legal basis for the preservation and support of a peculiar social institution of the indigenous small-numbered peoples of the North of the Republic of Sakha (Yakutia), a nomadic family living in extreme natural and climatic conditions, which is the basis for the conservation and development of reindeer husbandry, and is aimed at improving the socio-demographic situation in the Republic of Sakha (Yakutia) and the formation of the ethno-cultural identity of indigenous small-numbered peoples of the North, leading a nomadic way of life, in the Republic of Sakha (Yakutia). Nomadic family - a family moving during the calendar year to places of nomadic, reindeer pastures for the rational (inexhaustible) use of feed, aquatic biological and hunting resources, carrying out traditional economic activities and dealing with traditional crafts of indigenous small-numbered peoples of the North, the main function of which is the upbringing of children and the transfer from generation to generation of family values of the indigenous small-numbered peoples of the North, based on historical experience of ancestors in the field of traditional nature management, original culture, language and traditional knowledge. The objectives of this Law are: (a) to increase the status of nomadic families in the Republic of Sakha (Yakutia); and (b) establishment of a system of economic, social and legal guarantees to ensure the improvement of the living standards of the nomadic family. The targets of this Law are: (a) to create conditions for improving the demographic indicators of the indigenous small-numbered peoples of the North who are nomadic, living in the Republic of Sakha (Yakutia); (b) provision of social guarantees to members of nomadic families on the basis of the principle of targeting, differentiated and individual approach; (c) the revival and preservation of the nomadic way of life; (d) preservation of traditional knowledge, family and ethno-pedagogical traditions, respect and protection of cultural heritage; and (e) improving the conditions for the education and upbringing of children in nomadic conditions, protecting the health of members of nomadic families. The principles of state support for the nomadic family are: (a) the recognition and preservation of the nomadic way of life in the Republic of Sakha (Yakutia); (b) equal access of the nomadic family to state support in accordance with the terms of its provision; (c) consideration of the specific features of the vital activity of the nomadic family when providing state and other services by the executive authorities of the Republic of Sakha (Yakutia); and (d) providing the members of the nomadic family with equal opportunities in the fields of education, health, culture and social security. The procedure for registering the status of a nomadic family is established by the Government of the Republic of Sakha (Yakutia). In order to legalize the status of a nomadic family, register of nomadic families shall be instituted and updated in the Republic of Sakha (Yakutia). The state support of the nomadic family provides: (a) conservation and protection of places of nomadic territories for traditional nature management, traditional economic activities and a nomadic way of life; (b) ensuring the protection and preservation of family values, traditional knowledge of the indigenous small-numbered peoples of the North, leading a nomadic way of life, as an important component of the ethno-cultural development of indigenous small-numbered peoples of the North; (c) ensuring the availability of preschool, basic general and additional education without detaching children from parents who lead a nomadic way of life; (d) establishment of a quota for a targeted admission at the expense of budgetary allocations of the state budget of the Republic of Sakha (Yakutia) to organizations engaged in educational activities on the basis of a contract on targeted admission and a contract on targeted education in accordance with the legislation of the Russian Federation and the legislation of the Republic of Sakha (Yakutia); (e) ensuring the provision of annual medical preventive examinations, the provision of free medicines and preparations, as well as sanatorium-resort and rehabilitation treatment for members of the nomadic family; (f) organization and support of small forms of entrepreneurship in the collection and processing of berries and medicinal plants (wild plants), the production of traditional crafts in places of nomadic activities; (g) modernization of the republican satellite communication network in places of nomadic migration; and (h) provision of free legal aid within the framework of the state system of free legal aid in accordance with the legislation of the Republic of Sakha (Yakutia).
