Resumen

This Regional Act makes provision in matter of regional and local protected nature areas by implementing the general principles laid down in Act No. 394 of 6 December 1991. The Region shall create protected nature areas in order to protect and restore the landscape and the environment as well as to ensure the proper use of the territory. In addition, the Region shall promote the establishment of inter-regional protected areas and shall collaborate with the governmental administration within the management and promotion of national protected nature areas (art. 4). The basic instrument for the functioning and management of protected areas is the regional plan referred to in article 5, to be approved by the Regional Council upon advice given by the Provinces, Mountain Communities and the Communes. The plan shall, inter alia, determine and classify nature areas of local interest. The Region Council is empowered to approve the regional management plan intended for implementing the former plan, too (art. 6). Protected nature areas are established by Regional Act, in accordance with the principles and rules provided for in their respective regional plans. The Act shall delineate the area's perimeter and determine the managing entity. Each protected area shall have: (a) a special plan (to be adopted by the managing entity), subdividing the territory into the different zones referred to in article 12 ; (b) a socio-economic plan; (c) a regulation setting out management criteria. Adjacent areas may be created for protective purposes, too (art. 17). The entity in charge of the management of protected nature areas must forward annually to the Regional Council a report concerning the activities that have been peformed (art. 19).
